S’Court The Supreme Court of Nigeria has ordered a fresh hearing in the leadership crisis rocking the African Democratic Congress, sending the case back to the Federal High Court of Nigeria for determination.
In a unanimous judgment delivered on Thursday, Justice Mohammed Garuba held that the interim order earlier granted in the matter was unnecessary and improperly issued.
The apex court faulted the decision of the lower court to grant what it described as an unwarranted directive during the pendency of the dispute, stressing that such an order was not justified in the circumstances.
Justice Garuba ruled that the appropriate step is for the substantive issues surrounding the ADC leadership tussle to be fully heard and determined by the Federal High Court.
The ruling effectively resets proceedings in the case, paving the way for a comprehensive hearing where all parties involved in the dispute are expected to present their arguments.The development comes amid internal tensions within the ADC, as stakeholders await a final resolution of the crisis ahead of future political activities.
